ALABAMA CONSTITUTIONAL MILITIA BYLAWS
The purpose of these bylaws is to explain the mission, goals & organizational structure of the AL-CM
MISSION:
MISSION:
To support the States Organized Militias.
To defend the Constitution of the Several States and the Constitution of the United States of America. To uphold and to defend the Bill of Rights, seen as unalienable, and given by our creator to free men that they may remain free.
To support the County Sheriff's Departments and State Police. To insure that all citizens, regardless of race, color, religion, sex, physical characteristics, or national origin, shall have the right and opportunity to due process of the law as established and guaranteed by the great document which guides this great nation.
To provide assistance to our communities in any emergency situation. To set up volunteer emergency response teams in each brigade area and work to help establish community watch programs and routes.

GOALS:
It will be the goals of the Alabama Constitutional Militia to:
a) PRESENT itself to the citizens of the state as a well-regulated, and well-trained, organization that is here to benefit them.
b) ASSIST citizens in the event of any emergency situation, and answer the call of the state should the need arise.
c) ESTABLISH a cohesive leadership structure, able to instruct and handle task as needs arise.
d) TRAIN its membership in the many disciplines of disaster preparedness and firearms proficiency.
e) EDUCATE its members on the rights and duties of a citizen, according to The Constitution of the United States of America, the Bill of Rights, And to acknowledge how America's early history reveals an inevitable conflict between any tyrannical government and man's innate desire to be free.
f) INFORM its members of local, national, and global events which could infringe on their Constitutional rights and impact the direction of the nation.
g) ENCOURAGE its members and those in our communities to support the Constitution Of the United States of America and the Bill of Rights.
h) UPHOLD the rule of law whereby all citizens have the right to trial by a jury of their peers in a court of law.

ORGANIZATIONAL STRUCTURE:
In order to achieve our goals a military command structure has been adopted. All elements of the Alabama Constitutional Militia will be under the command of the State Command. Each brigade commander will be responsible for assigning rank and duties within their brigade. The mission of each brigade is to support the goals of the Alabama Constitutional Militia as a whole. Upon taking the oath, each member will be assigned a position inside their brigade.
Officers and Non Commissioned Officers that are appointed to command and support positions are given their authority by the brigade commander. As a member, you are expected to support and follow the orders and directives of command. Trust and teamwork are the cornerstones of our organization. If you feel compelled to disobey, or openly reject an order, you can choose to withdraw or respectfully request to address you grievances, without prejudice. Provision have been made to remove members who discredit the Alabama Constitutional Militia though a hearing by the Disciplinary Counsel.

MEMBERSHIP:
Membership in the Alabama Constitutional Militia shall be open to any citizen over the age of 18 regardless of sex, race, and religion, physical characteristic or national origin. Membership is voluntary and will last until the member withdraws or is dismissed by proper authority.
For the protection of the community and the Alabama Constitutional Militia, members are forbidden to possess, use or carry any illegal substance or alcohol during any organizational function. Membership is not open to anyone with a felony conviction, moral turpitude conviction, such as domestic violence, or being adjudicated mentally ill. Members must be willing and able to submit to a background check and/or drug test .
These terms are binding and non-negotiable upon application for membership. Any falsification will be considered breach of trust and grounds for immediate dismissal from the Alabama Constitutional Militia.
For the protection of the community and the Alabama Constitutional Militia, members are forbidden to possess, use or carry any illegal substance or alcohol during any organizational function. a) Member-- Is an active participant in the Alabama Constitutional Militia activities and abides by the rules and regulations of the Militia; has completed the 6 month probationary period; has provided the information required by the Leadership Staff, and, has taken the Alabama Constitutional Militia Oath and submitted a signed copy of that oath to the Leadership Staff. An Alabama Constitutional Militia State Patch and name tape will be provided to members once dues have been paid. Active members have the right to participate in our elections when they are held.
By the term, "active participant," we mean that each member will make contact with his/her command at least once a month in order to stay informed of important information and current events. We understand situations do occur which can limit a member's participation. When those situations do occur, it is important for you to notify us so that we know you are alright. If we do not hear from you we will assume something is wrong and take appropriate actions to help you. Our members are like family, and like family, we will worry about you. Members will respond to request for contact in a timely manner. Members must attend at least one meeting a quarter, unique circumstances will be reviewed on an individual basis.
b) Supporter -- A supporter who chooses to remain anonymous. A supporter does not take the oath; has no rights to participate in our elections; and, has no say in the running of the Alabama Constitutional Militia.
WITHDRAWAL / DISMISSAL:
A member may voluntarily withdraw their membership in the Militia at any time by notifying the Leadership Staff in writing of their decision. Following the 6 month probationary period, a member may be dismissed from membership only after a formal hearing by the disciplinary counsel. Even after leaving the organization information pertaining to our members and meetings should continue to be held in confidence and not shared with those outside the organization.
If a member is terminated from the Alabama Constitutional Militia due to disciplinary actions, or at any time a member voluntarily withdraw from the Alabama Constitutional Militia without prejudice for conscience sake, that member will promptly return all issued equipment and/or records in their possession to the appropriate command personnel.
CONDUCT:
Members are highly encouraged to live exemplary lives as outlined in the Alabama Constitutional Militia Code of Conduct and the Laws of their State of Residence. Blatant violation of the law places the legitimacy of the Alabama Constitutional Militia at risk. Just one member can jeopardize the Unit by an illegal act; those wishing to discredit us look for such opportunity.
In order to protect the body as a whole, members may be brought up for disciplinary actions and will be subject to a disciplinary counsel. The Disciplinary Counsel will consist of the active command personnel for the state and the brigades. The Disciplinary Counsel will hear the facts of the case and will decide upon the recommended course of action for the accused member. Members may stand trial for such acts that would discredit the Alabama Constitutional Militia or place its members at risk. No charge will be brought before a disciplinary counsel unless supported by at least two witnesses.
The ruling of the Disciplinary Counsel can result in a member being terminated from the Alabama Constitutional Militia. It is the right of each member to appeal to authority within the direct chain of command regarding grievances. Do not be disrespectful but show respect when addressing any thing you may disagree with.
RECRUITING:
Under no circumstances are Militia members to discredit the Alabama Constitutional Militia by pressuring citizens to join, or by pressuring citizen to contribute material or financial support. All material and financial contributions will be accepted with the clear understanding that the inalienable rights of all will be protected without qualification. Any prospective member must be legally able to own a firearm and submit to a background check.
ABUSE OF RANK OR POWER:
Abuse of any members will not be tolerated.
As an Officer, or a NCO, is promoted, never let that rank go to your head. The Alabama Constitutional Militia does not, and will not, single out an individual member, or unit, based on prejudice or for personal gain. Any Member who has any subordinates shall treat each individual respectfully. Remember, we are all here voluntarily. We must understand that those we are appointed over have a duty to their family first. There will be times when there is a meeting, or training event, which a member may not be able to attend. Never call a member out in front of others for disciplinary reasons. If you must talk to a member for disciplinary reasons, call that person aside and speak to him/her privately. Remember, in order to get respect you must give respect. Any member who violates these guidelines will be subject to a disciplinary hearing to decide the appropriate actions.

OATH:
All members will be required to take the oath and sign it, to uphold the Constitution of the United States and the Constitutions of the Several States and to protect it from all enemies. A copy of the oath will be forwarded to the state command with contact information for the member.
NON-COMMISSIONED MEMBER OATH:
"I, ___________________________, do solemnly swear this, ____day of __________________, _______________ to uphold and defend the Constitution of the United States and the Constitutions of the Several States. I hereby take an oath of service to the Alabama Constitutional Militia and all lawful Citizens of the United States of America. I will obey the Leaders over me as far as my conscience will allow. If needed, I will fight with courage, and honor, and show mercy when victorious. I will never surrender for as long as I have the means to resist. I will to the best of my ability to withhold all information from any enemy, no matter what may occur. I will never act in a way that would bring disgrace upon myself, this country or the Militia. I understand I take this position voluntarily and am free to leave at anytime. This I do pledge, under God, and upon my honor."
COMMISSIONED OFFICER OATH:
"I, ___________________________, do solemnly swear this, ____day of __________________, _______________, having been appointed an officer in the Alabama Constitutional Militia, in the grade of (rank), do solemnly swear that I will support and defend the Constitution of the United States and the Constitutions of the Several States against all enemies, both foreign and domestic; that I will bear true faith and allegiance to the same; that I will take this obligation freely, without any mental reservation or purpose of evasion; and that I will willing and faithfully discharge the duties of the office upon which I am about to enter; So Help Me God."
"I, ___________________________, do solemnly swear this, ____day of __________________, _______________ to uphold and defend the Constitution of the United States and the Constitutions of the Several States. I hereby take an oath of service to the Alabama Constitutional Militia and all lawful Citizens of the United States of America. I will obey the Leaders over me as far as my conscience will allow. UNIFORM & EQUIPMENT:
As a member of the Alabama Constitutional Militia, you are encouraged to procure and maintain items of uniform and equipment. The state wide field uniform for all members is the, A-TACS FG Modern Tactical Uniform. Members are requested to purchase their uniform as they are financially able to do so. Public uniforms will be black polo shirts with our logo and coyote tan tactical pants. Get with your command on the polo shirts. When in uniform, you represent the Unit; therefore, your uniform will be kept clean, all buttons will be buttoned, shirts will be tucked in, and patches will be properly placed. Proper impression is very important to the community.
All members must legally be able to own a firearm. It will be required of all members, not otherwise opposed for conscience sake, to have their own firearm, ammunition, and gear.
Organization members are required to remain proficient in the maintenance and safe operation of their firearms. We recommend that members have "go bag(s)" prepared for emergency situations. If you are restricted to limited funds, set your priority on the essentials instead of over priced gadgets. A well prepared emergency kit is vital.
All members will be expected to obey all existing state and local firearms laws. Only in self-defense will a member discharge his/her weapon. Members are expected to abide by all hunting rules and regulations pertaining to the use of firearms for that purpose.
All members must legally be able to own a firearm. It will be required of all members, not otherwise opposed for conscience sake, to have their own firearm, ammunition, and gear.

COMMUNICATIONS:
In the case of a natural, or man made disaster, communication is critical; therefore, the Citizen Band (CB) Radio and Ham Radio will be the principal forms of communication for the Alabama Constitutional Militia. Persons taking part in emergency communications should have a valid Ham Radio operator license. Members should also work to procure GMRS/FRS radios for local communications. Please be aware that GMRS frequency use requires a GMRS license.
MEETINGS & TRAINING:
Periodic meetings and training events are necessary and shall be scheduled to achieve the overall goals of the Alabama Constitutional Militia. Members will be notified of times and places. While it is intended that the militia intrude as little as possible in the private lives of its members, it is also clear that individual members are volunteers and must be ready to meet periodically and to deploy as the need arises. Regular meetings and training will be scheduled in each brigade for the third Saturday of each month with any additional meetings to be scheduled by their command. These may take place at a members home, public park, or local target range. Locations will be announced at least 2 weeks in advance. The minutes of our meetings and any material from or pertaining to our meetings is to be held in confidence and not shared with outside sources.
